United Network Solutions Limited Web Hosting Service Agreement

DEFINITIONS
“United Networks” is operated by “United Network Solutions Limited”.
“United Network Solutions Limited” means United Network Solutions Limited,
  of Room D, 12/F., Block 1, Goldfield Industrial Building,   144-150 Tai Lin Road, Kwai Chung , N.T., Hong Kong.
“the Customer” means any company or person who has requested to use the Services.
“Agreement” means any agreement between the parties which expressly or impliedly incorporates these Terms and Conditions as the   context demands.
“Fees” means the installation fee, monthly fee and other charges in respect of the Services published from time to time
  by United Network Solutions Limited.
“Operating Rules” means the rules relating to the Services published from time to time by United Network Solutions Limited.
“Services” means the services as described in the Agreement , virtual hosting, domain registration, hardware supply, and services offered   by as the context requires.

1)All accounts are set up on a pre-pay basis. Setup fees are charged for all new accounts and major account changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. United Network Solutions Limited reserves the right to change prices at any time, unless other terms have been agreed upon. Any account not brought current within a week (14 days) of e-mail notice or exceeding this time frame in any way is subject to suspension. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies United Network Solutions Limited in writing for a request for termination of services. The customer’s notification must be acknowledged by United Network Solutions Limited. All payment is in Hong Kong dollar.

2)The Customer is responsible for and must provide all equipment necessary to access the Service and must comply at all times with United Network Solutions Limited’s requirements as regards mode of access and/or use of the Services. The Customer also agrees to abide by (1) generally accepted rules of conduct relating to the proper use of Internet resources (2) the Operating Rules and (3) the Agreement. United Network Solutions Limited shall have the right to modify, vary or discontinue any aspect of the Services (whether to the Customer alone or otherwise) at its sole discretion and without prior notice. United Network Solutions Limited reserves the right to disconnect or deactivate any of the Customer’s equipment or software at any time without prior notice.

3)The Customer shall be entirely responsible for all use of the Services and agrees to indemnify United Network Solutions Limited against all and any liability arising, directly or indirectly, and in any jurisdiction, out of the use of the Services. The Customer agrees to abide by all applicable laws (whether of Hong Kong or of any relevant jurisdiction) relating to the use of the Service, in particular, but without limitation, the Customer shall not access or publish any matter which violates any laws (whether of Hong Kong or of any relevant jurisdiction) and warrants that its use of the Services does and shall not, directly or indirectly, infringe any third party’s intellectual property rights in any jurisdiction.

4)The Customer expressly agrees that use of the Services is at the Customer’s sole risk and that the entire risk as to the quality and performance of the Services is with the Customer. Neither United Network Solutions Limited nor any or its directors, employees or agents warrant that the Services will be uninterrupted or error free, or give any warranty as to be obtained from use of the Services. In no event will United Network Solutions Limited or its directors, employees or agents be liable to the Customer for any damage, (including, but without limitation, special, incidental, or consequential damage) arising from the use of, or inability to use (for what reason), the Services, including but not limited to damages resulting from loss of data or loss of profits but not including death or personal injury due to the negligence of United Network Solutions Limited, its directors, employees or agents.

5)Any Internet Protocol address(es) allocated by United Network Solutions Limited to the Customer, remain(s) the property of United Network Solutions Limited. The Customer undertakes not to advertise, or otherwise to broadcast, such address(es) upon termination of the Services or the Agreement,.

6)The Customer is responsible to inform United Network Solutions Limited in case intent to terminate service before 30 days. The customer’s notification must be acknowledged by United Network Solutions Limited.

7)If the Customer is in breach of any of the terms of the Agreement, United Network Solutions Limited may, at its sole discretion, either suspend the Customer’s access to and use of any of the Services until such breach is remedied or terminate the Agreement and the Customer’s access to and use of any of the Services. Reinstatement will be at the sole option of Internet Service Centre and upon such terms and conditions as it shall determine. Either party any terminate the Agreement on two (2) months’ notice in writing. On termination, United Network Solutions Limited will be entitled to payment for all Services rendered up to termination.

8) If any provision of this Agreement is found to be invalid the other provisions shall remain in full force and effect. All obligations and restrictions on the Customer under this Agreement will survive the termination of this Agreement and or the termination of the provision of any of the Services. No waiver by either party of a breach of any provision of this Agreement, nor delay or omission to exercise any right, shall constitute a waiver of any other breach or default by the other party.

9) Unless otherwise agreed in writing and signed by both parties, this Agreement constitutes the entire agreement between the parties. This Agreement is governed by the laws of Hong Kong and the parties hereby submit to the non-exclusive jurisdiction of the courts of Hong Kong.

10)Any unauthorized use of accounts or computers by a United Network Solutions Limited customer, whether or not the attacked account or computer belongs to United Network Solutions Limited, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation, and civil or criminal legal action, depending on the seriousness of the attack.

11)Commercial advertisements with e-mail Unsolicited commercial advertisements are not allowed in e-mail, and will likely result in account suspension or cancellation. Commercial advertisements are unwelcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter for whether advertising is allowed or not. "Spamming," or sending a message to many different off-topic newsgroups, is particularly unethical and will be treated as such. Sending a message, especially an advertisement, to more than five or six recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. E -mail is a person-to-person medium, not a broadcast medium. No refunds will be given if your account is terminated for Spam.

12)We do not allow clients to install their own chat rooms, without approving it with the United Network Solutions Limited Support Team. Most chat rooms tend to be large system hogs and we cannot allow it as an account option. How, we do provide a choice of Java chat rooms for a small extra charge that will more than fill your needs and run without hindering the performance of the machine for others.

13)This service requires minimum one-year service period. If the client terminate the contract for any reason within one year, the client will be billed 100% of total monthly charge of the remaining months or the client can replace this contract with another contract of equal or greater than the contract revenue commitment

14)When applying Hong Kong domain names (yourcompany.com.hk), you should have a Business Registration to prove the existence of the company. Each Business Registration can only be used to apply one Hong Kong domain name. US domain name registration does not have the above restrictions. 15. All payments received by United Network Solutions Limited are not refundable or transferable.
